Introduction

These Terms of Service ("Terms") govern your use of DrillSpark ("Service") provided by Tsumugiya Inc. ("Company", "we", "us", or "our"). By using the Service, you agree to these Terms.

Account Registration

To use the Service, you must create an account by agreeing to these Terms and completing the registration process. Your account is personal and non-transferable.

Important: Each person may register and use only one account. Creating or using multiple accounts is prohibited.

Your Content

You retain all ownership rights to the content you create using the Service, including flowcharts, diagrams, and other materials ("Your Content"). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, store, and display Your Content solely for providing and improving the Service.

• You are responsible for ensuring you have the necessary rights to any content you upload or create
• We do not claim ownership of Your Content
• Upon account deletion, the license terminates and Your Content will be deleted in accordance with our data retention policies

AI Features

The Service includes AI-powered features for flowchart generation provided by third-party services (Google Gemini, OpenAI). By using these features, you agree to the following:

• Your prompts and context may be processed by third-party AI providers to generate diagrams
• We do NOT use Your Content to train AI models
• AI-generated outputs may not be unique and similar outputs may be generated for other users
• You are responsible for reviewing and verifying AI-generated content before use
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content

Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Engage in activities related to criminal acts
• Interfere with or disrupt the Service's servers or networks
• Collect personal information about other users without consent
• Attempt unauthorized access to the Service or its systems
• Use AI features to generate content that infringes intellectual property rights
• Use AI features to generate illegal, harmful, or discriminatory content
• Attempt to reverse engineer or extract AI models or training data
• Circumvent usage limits or credit systems through technical means
• Engage in any other activities we deem inappropriate

Service Availability

We may suspend or interrupt the Service without prior notice in the following circumstances:

• System maintenance or updates
• Force majeure events (earthquakes, natural disasters, power outages)
• Technical failures or accidents
• Third-party AI provider outages or service discontinuation
• Any other circumstances where we determine the Service cannot be provided

Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We are not responsible for any disputes between you and other users or third parties.

Data Export and Account Deletion

You may export your data at any time through the Service's export functionality. Upon account deletion:

• Your account and all Your Content will be permanently deleted immediately
• This action is irreversible - please export your data before requesting deletion
• Some data may be retained as required by law (e.g., payment records for up to 7 years)

Changes to the Service

We may change the Service or discontinue features at any time. For significant changes, we will provide reasonable advance notice through the Service or by email.

Changes to These Terms

We may update these Terms from time to time. For material changes, we will generally notify you in advance through the Service or by email. However, in urgent circumstances (such as security issues or legal requirements), changes may take effect immediately without prior notice. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

International Users

The Service is operated from Japan. If you access the Service from outside Japan, you are responsible for compliance with local laws.

Governing Law

These Terms are governed by the laws of Japan. Disputes shall be subject to the exclusive jurisdiction of courts in Japan.

This choice of law shall not deprive consumers in the EU, UK, or other jurisdictions of protections afforded by mandatory local consumer protection laws.
